Commercial regulations for businesses

  1. When you offer goods or services for sale, we consider all messages and materials related to your goods or services, including descriptions, prices, fees, taxes, and/or required legal information and notices, to be transactions. Transactions must comply with the rules set forth below, as well as applicable terms, laws, and regulations.
  2. You are solely responsible for your transactions and your terms of sale, privacy policies, or other terms applicable to your dealings with users.
  3. We are not responsible for the processing, payment, or fulfillment of sales related to your transactions.
  4. You are solely responsible for determining, collecting, withholding, reporting, and remitting all applicable duties, taxes, fees, and additional costs related to sales in connection with your transactions.
  5. The examples below are representative, but not exhaustive.
  6. The sale and offer for sale of the following items are prohibited:

Illegal products or services

  • Regulation: Companies must not engage in transactions or exchanges involving illegal products or services.

Drugs and medications, prescription, recreational, or other

  • Regulations: Companies must not engage in the sale of illegal drugs and medications, prescription drugs, or recreational drugs. Manufacturers and healthcare services that do not engage in direct sales activities are permitted.
  • Examples :
    • Drugs, including cannabis and cannabis derivatives
    •  Accessories intended for drug use, including pipes and bongs
    •  Prescription drugs

Tobacco products and related accessories

  • Regulation: Companies must not participate in the sale of tobacco products or accessories intended for their consumption.
  • Examples :
    • Clothing displaying the logo of a tobacco brand
    •  Cigarettes, cigars, and chewing tobacco
    •  Pipes and accessories intended for tobacco consumption
    •  Cigarette rolling machines
    •  Hookahs
    •  Bangs
    •  Rolling papers
    •  Electronic cigarettes or smoking devices

Alcohol

  • Regulation: Companies must not participate in the sale of alcohol.
  • Examples :
    •  Books or DVDs about alcohol
    •  Alcohol-related items, including glasses, coolers, and bottle holders
    •  Alcoholic beverages
    •  Alcohol production kits

Dangerous dietary supplements

  • Policy: Businesses must not engage in the sale of dangerous dietary supplements, as determined by WhatsApp at its sole discretion.
  • Examples :
    •  Anabolic steroids
    •  Chitosan
    •  Comfrey
    •  Dehydroepiandrosterone
    •  Ephedra
    •  Human growth hormones

Weapons, ammunition, or explosives

  • Regulation: Companies must not engage in the sale or use of weapons, ammunition, or explosives.
  • Examples :
    •  Promotion of safety training or legal gun permits
    •  Firearms or firearm components
    •  Paintball guns
    •  Air guns
    •  Fireworks
    •  Pepper spray
    •  Taser guns
    •  Shooting ranges
    •  Firearms trade shows

Animals

  • Regulation: Companies must not participate in the sale of animals.
  • Examples :
    •  Animal cages
    •  Pet products (toys, collars, etc.)
    •  Veterinary services
    •  Grooming services
    •  Pension services
    •  Pet adoption service
    •  Live animals
    •  Livestock
    •  Prohibited animal parts, including, but not limited to, bones, teeth, horns, ivory, taxidermy, organs, external limbs, secretions, or dead animals
    •  Any product or part, including, among others, leather, skin, fur, wool, or hair from dogs, cats, and endangered or threatened animals.

Products or services for adults

  • Regulation: Companies must not participate in the sale or use of adult products or services.
  • Examples :
    •  Products promoting family planning and contraception by focusing on contraceptive characteristics rather than sexual pleasure or improved sexual performance
    •  Sexual accessories
    •  Adult entertainment videos or live broadcasts
    •  Sexual performance enhancement products
    •  Sexually suggestive services

Body parts and fluids

  • Regulation: Companies must not participate in the sale of human body parts or bodily fluids.
  • Examples :
    •  Blood donation centers
    •  Blood
    • Hair extensions and wigs
    •  Urine
    •  Body parts
    •  Organs
    •  Human tissues
    •  Teeth

Medical and health products

  • Regulations: Companies must not engage in the sale of certain health products, including medical devices and nicotine-containing smoking cessation products. Manufacturers and health services that do not engage in direct sales activities are permitted.
  • Medical devices – Examples :
    •  Fitness and wellness accessories
    •  Contact lenses
    •  Bandages and orthopedic devices for physical injuries
    •  Thermometers
    •  Test kits for medical conditions or diseases
    •  Breast pump
    •  First aid kits
  • *Smoking cessation products – Examples *:
    •  Nicotine patches
    •  Nicotine chewing gum

Items or products of an overtly sexual nature

  • Regulation: Companies must not present products or services in a sexually suggestive manner.
  • Examples :
    •  Implied nudity
    •  Implied sexual acts
    •  Zooms on images of a sexual nature

Gambling services

  • Regulations: Companies must not engage in the trade or promotion of gambling, games of skill, or lotteries, including online casinos, sports betting, bingo (lotto), or poker if it involves payment.

Dating services

  • Regulation: Companies must not engage in the business or promotion of dating services.

Products or items that facilitate or encourage unauthorized access to digital media

  • Regulation: Companies must not participate in the sale of devices that facilitate or encourage the unauthorized streaming of digital content or the hacking of electronic devices.
  • Examples :
    •  Additional equipment for streaming devices such as keyboards and remote controls
    •  Sale of streaming devices equipped with software that facilitates unauthorized access to content
    •  Unlocked (jailbroken) or loaded devices
    •  Jamming or de-jamming devices
    •  Electronic listening devices

Digital and subscription services, including links or processes related to the sale, renewal, or upgrade of subscriptions

  • Rule: Businesses must not participate in the sale, including renewals, upgrades, etc., of digital content, digital subscriptions, or digital accounts.
  • Examples :
    •  Genuine audio or video CDs, DVDs, and Blu-ray discs
    •  Digital devices, including smartphones, video game consoles, and televisions
    •  Downloadable content, including PDF files, music, games, movies, etc.
    •  Digital accounts, including gaming accounts
    •  Digital subscriptions and streaming services on the Internet, including for televisions, mobile devices, etc.
    •  Digital vouchers

Models, goods, items, or corporate services that we determine to be potentially or actually fraudulent, misleading, offensive, or deceptive, or that are potentially or actually abusive, inappropriate, or exert excessive pressure on targeted groups.

  • Regulation: Companies must not engage in the sale of misleading, counterfeit, deceptive, or offensive offers or products.
  • Examples :
    •  Multi-level marketing
    •  Penny auctions
    •  Initial coin offerings and binary options
    •  Payday loans, salary advances, peer-to-peer loans, debt collection, and sureties
    •  Diets, weight loss, or other health-related products that imply or attempt to elicit negative self-perception

Real, virtual, or counterfeit currency

  • Regulation: Companies must not engage in the sale of real, virtual, or counterfeit currency.
  • Examples :
    •  Cash (cash and cash equivalents, and coins)
    •  Replica or accessory coin
    •  Electronic currency or cryptocurrency
    •  Active credit or debit cards
    •  Store credit cards or store coupons
    •  Prepaid credit or debit cards
    •  Checks or checkbooks
    •  Equipment for manufacturing counterfeit currency or financial instruments

Infringement of third-party rights

  • Rules: Transactions must not involve content that infringes or violates the intellectual property rights of a third party, including their copyright or trademark rights. This includes, but is not limited to, the sale of counterfeit products, such as items that copy the brand (name or logo) and/or distinctive features of another company's products in order to imitate a genuine product.
  • Examples :
    • Counterfeits, imitations, or replicas of branded items, or publications offering items that may mislead consumers as to the source, sponsorship, or affiliation of such items.
    • Unauthorized or pirated copies of copyrighted works, such as videos, movies, television shows, video games, CDs or other musical works, books, etc.
